Mrs Donoghue went to a cafe with a friend. Her friend bought her a ginger beer, which was poured into a tumbler. Mrs Donoghue drank some of it, and the remainder was then poured into the tumbler, revealing the decomposed remains of a snail. Mrs Donoghue suffered shock and severe gastro-enteritis. She had not purchased the drink herself and had no contractual relationship with the manufacturer. She sought to bring a claim against the manufacturer of the ginger beer for negligence.
